退休后还想发挥余热,去海外工作可行吗?答案是:可以,但必须守住“合法”这条底线。结合我国法律法规,银发人才出国打工前先记牢三件事。
第一件事:办对护照和目的地的“工作签证”
根据《中华人民共和国出境入境管理法》,中国公民出境入境应依法申请护照或其他旅行证件。出国务工必须办理目的地国家的工作签证,切记不能用旅游签证直接打工——这属于非法就业,可能被当地移民部门遣返,甚至影响未来再次入境。持旅游签证或“退休签证”在境外从事有偿工作,都会触碰签证条款红线。
第二件事:走正规的对外劳务渠道
我国对外劳务合作受《对外劳务合作管理条例》(国务院令第620号)等法规规范,应通过具备商务部核准经营资格的对外劳务合作企业办理,签订正规合同,明确薪资、工时、工伤、保险等条款,避免“黑中介”和高额“中介费”陷阱。
国家层面也持续完善海外服务支撑,推动建设为对外承包工程和劳务合作企业提供“一站式”公共服务的综合平台。行业整体规模保持增长,据商务部数据,2024年我国共派出各类劳务人员40.9万人,较上年增长17.9%。
第三件事:出国后别忘了养老金“生存认证”
已享受国内养老保险待遇的退休人员,出国打工期间原则上可继续领取基本养老金,但需每年按时进行生存认证,否则可能被暂停发放,回国后还要重新申请恢复,耗时耗力。请提前了解国内社保部门的线上认证方式,安排好认证周期。
特别提醒
出国打工前,还应主动了解目的地国家的最低工资、加班、劳动保护等规定,并购买国际医疗保险。遇到纠纷时,因身处境外,维权难度相对更高,务必做到手续齐全、合同明确、保留证据。

Can Retirees Work Abroad Legally? Passport, Visa, and Pension: Three Things to Get Right
Want to keep contributing after retirement by working overseas? The answer is yes, but you must hold the line on "legality". Drawing on Chinese laws and regulations, silver talent should remember three things before working abroad.
First: Get the Right Passport and a "Work Visa" for the Destination
Under the Exit and Entry Administration Law of the People's Republic of China, Chinese citizens must legally apply for a passport or another travel document when leaving and entering the country. Working abroad requires a work visa for the destination country. Never work directly on a tourist visa — this is illegal employment and may lead to deportation by the local immigration authority, or even affect future re-entry. Engaging in paid work abroad on a tourist visa or "retirement visa" crosses the red line of visa terms.
Second: Use Formal Overseas Labor Channels
China's foreign labor cooperation is governed by regulations such as the Regulations on the Administration of Foreign Labor Cooperation (State Council Decree No. 620). You should go through foreign labor cooperation enterprises qualified by the Ministry of Commerce, sign formal contracts, and clarify terms on wages, working hours, work-injury and insurance, while avoiding "shady brokers" and excessive "agency fee" traps.
At the national level, overseas service support keeps improving, and a "one-stop" public-service platform for overseas contracted projects and labor cooperation enterprises is being built. The industry as a whole keeps growing; according to the Ministry of Commerce, China sent 409,000 dispatched workers abroad in 2024, up 17.9% from the previous year.
Third: Don't Forget the Pension "Survival Verification" While Abroad
Retirees who already receive domestic pension insurance benefits may, in principle, continue to collect their basic pension while working abroad, but they must complete the annual survival verification on time; otherwise pension payments may be suspended, and it will take time and effort to reinstate them after returning. Please learn the online verification methods of the domestic social security authorities in advance and arrange your verification schedule.

Before going abroad to work, you should also proactively learn about the destination country's minimum wage, overtime, and labor protection rules, and purchase international medical insurance. When disputes arise, because you are overseas, protecting your rights is comparatively harder, so make sure your paperwork is complete, your contract is clear, and you keep evidence.
